Timeshare buyers can sign lengthy contracts containing arbitration clauses immediately after high-pressure sales presentations, sometimes without fully understanding how those clauses may affect their legal rights. We are asking Congress to require a separate, clear arbitration disclosure and give every buyer 30 days to opt out without affecting their timeshare purchase.

Owners and non-owners can sign. You do not need to own a timeshare to support better consumer protection.

Why This Petition Is Needed

Timeshare contracts can be long, complex and signed immediately after presentations that may last several hours. The Federal Trade Commission itself warns consumers about high-pressure timeshare sales tactics and advises buyers not to make decisions under pressure.

Among the many provisions a purchaser may sign is an arbitration clause. That clause can determine how a future dispute with the timeshare company must be handled and may restrict the consumer’s ability to pursue that dispute through the courts.

We are not arguing that arbitration should be banned.

We are arguing that a decision this important should not be buried among dozens of pages of a purchase agreement or made while a consumer is still sitting at the sales table.

Consumers should be clearly told what arbitration means, what rights may be affected and how disputes would be handled.

Then they should be given 30 days away from the sales environment to decide whether arbitration is right for them.

That is not anti-business. It is informed consumer choice.

I support the Timeshare Arbitration Clause Petition calling on the United States Congress to introduce stronger consumer protections for arbitration provisions connected to timeshare purchases.

Timeshare buyers should receive a separate, clear and readable arbitration disclosure explaining what arbitration means and which rights may be affected. Consumers should then have a mandatory 30-day period to opt out of arbitration without cancelling their timeshare purchase, losing benefits or facing any other penalty.

Consumers should also be given an opportunity to review the disclosure away from sales pressure, and any arbitration provision should be unenforceable where the required disclosure and 30-day opt-out have not been properly provided.

Arbitration does not need to be banned. It should simply be a clear, informed and voluntary choice.
